I wanted to provide an update for those wondering about hearings for the remainder of April, since it seems to be imminent that an extension to the stay home order will be executed in the coming days –
Per Judge Jackson – “We’ve cancelled ALL jury trials through the month of April, and realistically at this point indefinitely. The government(s) keep setting deadlines for certain things and that’s fine. But the bottom line is until someone discovers a prevention or a cure for the virus most everything will be in limbo.
So, the short answer to your question is attorneys should not plan on hearings taking place during the month of April. Unless they are a REAL emergency. Where it involves the “sustaining or protecting of human life.” To borrow language from the Governor’s stay at home order.
Once the Governor acts in relation to the stay at home order I will put out something more official. But this is giving you and members of the Bar an honest assessment of what is most likely to happen.”
