Good afternoon,
The Michigan Supreme Court’s Commission on Well-Being in the Law’s Incentivizing Well-Being Committee is revisiting a proposed court rule that would allow attorneys to schedule a reasonable amount of personal time by providing advance notice to opposing counsel
and the courts where they have pending matters. Once notice is provided, matters would not be scheduled during the attorney’s secured leave period. A similar proposal received overwhelming support from the State Bar of Michigan Representative Assembly in 2019
(attached).
Before drafting and submitting an updated proposal, the committee would like to ensure that a broad range of legal stakeholders who may be impacted have an opportunity to weigh in so the proposal is well-rounded and practical.
The committee is considering updates that would:

Allow up to 20 days of secured leave per calendar year

Clarify secured leave does not change legal or court rule deadlines

Recommend a standard notice form developed by SCAO

Shorten the notice period from 90 to 60 days
